The law is not "what judges will do" [Holmes], but "the consequences of judges' decisions," i.e. the "new realities" [economic, social, moral, subjective] that are the CONTEXT determining the NEXT decision. But one cannot predict (1) the next judge's subjective response to (2) a future that reacts chaotically to forces like court decisions [e.g. Donaldson].
